PATINA MEADOW EVENT TERMS & CONDITIONS

AS A PARTICIPANT IN ANY PATINA HOME, PATINA HOME & GARDEN, PATINA SHED, PATINA MEADOW BLOOMERIE/POTTERIE LLC on or about the property and/or premises owned or controlled by The  Giannetti Living Trust Dated June 1, 1994 (“Patina Meadow” and “Patina”) Activity or Event, we invite you to see and experience our vision for a beautiful and sustainable life at Patina Meadow. By participating in the Event or Activity, you have agreed to abide by these Terms & Conditions:

Patina Meadow is a personal home and residence, and you are not permitted to approach or enter the premises without the express written authorization provided by the Invitation and a fully executed  Participation Agreement, Release and Assumption of Risk received by Patina. The Invitation is only valid for the time scheduled and payment, if any, is not subject to refund.

Patina Meadow is a working farm and animal habitat with growing crops and living animals. There are  various buildings and structures you may be invited to enter and others that are not part of your  Event/Activity. You will refrain from entering any structure unless permitted to do so by a Patina representative and you will voluntarily depart as requested to do so by a Patina representative. The  ground and surfaces between, in, and among the structures, fields, and fences may be of differing  material, uneven,soft, rocky, or deceptively steep. You may encounter trip and fall hazards or various  equipment and tools while on the premises or other hazards traveling to or from it, so please take  care, watch your step, or ask for assistance.

You may encounter all manner of dirt and soil; flowers and plantings including, but not limited to  peanuts; animals (farm & domestic); insects (scary & not); water, sunlight, rain, heat or cold  temperatures and you must protect yourself as you see fit. Most Events or Activities are intended to  last approximately 2 hours with many activities or viewing occurring outdoors. Please apply any  sunscreen or repellant before your arrival. Patina Meadow strives to utilize as few chemical products  as practicable and asks that you not bring additional chemicals to the property.

Proper attire for a farm is advised. Please wear comfortable, flat, durable, closed toe shoes with non slip soles. Try to avoid platforms, heels, slippery soles, or uncomfortable footwear. Clothing should  be appropriate for walking and moving around other people, plants, animals, insects, equipment,  and tools. You will encounter some hazards, readily visible and not, but you are responsible for your  own care. For pottery making, please beware of all equipment, materials and processes.

Children must be at least 10 years of age to participate in most Events or Activities and all minors  under the age of 12 must be accompanied by an adult over the age of 21 on a 1 to 1 ratio. All children  aged 12-18 must be accompanied by at least one adult over the age of 21. The adult is responsible  for the attire and behavior of any child in his/her care. All children must have a Participation  Agreement, Release and Assumption of Risk signed by the appropriate parent or legal guardian  received by Patina prior to the Event or Activity.

Please do not bring anything you cannot easily carry. There are no rest areas, lockers, or other places  to store personal items. The Events and Activities involve walking, which may include some seating  at varying times for some participants. Most areas are inaccessible to strollers, walkers, canes,  crutches, or scooters and the like. The Event or Activity may or may not include food or beverage  service. If food or beverage is not offered in the Invitation, you must bring your own water or non-alcoholic beverage if you want one, but we ask that you not bring any outside food or alcohol onto the  premises. Please also refrain from bringing any dangerous objects or destructive materials.

There are limited opportunities for those with disabilities, but Patina Home will endeavor to provide  some access to portions of the premises, if practicable. If you are non-mobile or have a disability that  would prevent you from freely navigating twists, turns, grades, narrow spaces, and bends on soft,  rocky, or uneven surfaces, we ask that you bring someone to assist you (Please Note your assistant  will require an invitation and must sign a Participation Agreement, Release and Assumption of Risk  prior to arrival).

If you have any fears or allergies to plants, animals, insects, pottery or anything else, you may want  to reconsider your participation. Your Event or Activity may include coming very near to or touching  plants and animals and some of them, plus the insects, may touch you without your consent. By  engaging in the Event or Activity, you agree to be exposed to plants, animals, insects, and the  elements as well as dust, dander, waste, drift, and odors in and around the property. We make pottery  on-site, so please know you may encounter materials associated with that process as well.

There may be limited restroom facilities during the Event or Activity, but you are again advised this is  not public property, nor a public event. You may be permitted to enter the property owners’ home  and, if you do, we ask you to treat their property as private and with respect. You are not permitted to  help yourself to the refrigerator, bathroom, closets, bed, or any other private areas inside the cabin.

Please do not remove any items, materials, or things (living or otherwise) from the premises and  please remove everything you brought with you when you leave. Please follow the directions of the  Patina representatives and, when it is time to leave, we request that you do so in an orderly fashion. 

​

We ask that you remain only in designated areas and that you do not open any locks, doors, gates, or  other impediments without the express permission of a Patina representative. Please touch or handle  only that which a Patina representative expressly allows you to touch or handle. Please try not to  scare or excite the animals, plants, or insects, nor the Patina representative, or any other  participants. Animals, plants, and insects occasionally escape or are present where not expected.

Do not engage any unattended or escaped animals, plants, or insects. Please advise the Patina  representative if you believe something is amiss. 

​

WARNING: Under Tennessee law, there is no liability for an injury to or death of a participant in an agritourism activity conducted at this agritourism location or by this agritourism professional if such  injury or death results from the inherent risks of the agritourism activity. Inherent risks of agritourism  activities include, among others, risks of injury inherent to land, equipment, and animals, as well as  the potential for you to act in a negligent manner that may contribute to your injury or death. You are  assuming the risk of participating in this agritourism activity. 

​

Your Event or Activity may begin at the Patina Home & Garden Store in Leiper’s Fork. You are traveling at your own risk to and from Patina Meadow. There is limited parking near the road and gate to the  premises. Please do not park with wheels on the pavement of the road and please be mindful of any  ditch, berm, culvert, boulder, or other parking hazard. You are responsible for your own vehicle or any  damage to someone else’s vehicle. We ask that you please drive and park with care.

Your invitation is for you and you alone. Please do not bring others with you or permit your invitation  to be used by someone else. Patina may keep a record of all visitors and we may send limited materials and information about our Patina offerings and ancillary products or services to you unless  you tell us otherwise in writing. 

​

We very much hope you enjoy your Event or Activity at our home and that you will be inspired to bring beauty and sustainability into your life.

Please read all the above for the specifics, but here’s the recap: 

​

By invitation only with Participation Agreement, Release and Assumption of Risk.  The Event or Activity is expected to last approximately 2 hours, most of it outside. No Children Under the age of 10, all others with adult supervision.  

You will encounter uneven ground, narrow places, and other hazards.  

You will encounter animals, plants, and insects. 

We grow Peanuts and other nuts and plants on the premises. 

We have livestock, farm animals, and domesticated animals on the premises.  We make pottery on the premises. 

Do not unlock any locks, doors, or gates and do notscare the animals.  

Dress accordingly and please be mindful of hazards. 

No photos or video inside the structures.  

We have limited restroom facilities. 

We may not offer food or drink and you may not bring food onto the premises. Remain in designated areas and do not remove anything you did not bring with you. We are not open to the public, so individuals with disabilities may not be able to participate.  You are not permitted to overstay your welcome and please treat our home with care. There is NO SMOKING/VAPING/or outside ALCOHOL permitted on or near the premises.  Patina Events and Activities are non-refundable and non-transferable. 

You agree to all Terms & Conditions by participating in the Patina Event or Activity.
